WakaAi Solutions Inc. ("we," "us," or "our") operates the Visa Refusal Analyzer service accessible at visarefusalanalyzer.com (the "Service"). By accessing or using the Service, you (a licensed immigration professional including lawyers, Regulated Canadian Immigration Consultants, and paralegals) ("you" or "Client") agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
1. Description of Service — For Licensed Professionals
The Visa Refusal Analyzer is an AI-powered analysis tool designed exclusively for licensed immigration professionals (lawyers, RCICs, and paralegals). The service reviews client refusal documents and generates draft analysis reports identifying potential refusal grounds, evidence gaps, legal vulnerabilities, and recommended pathways forward. All reports are drafts requiring independent professional review before use.
2. Draft Reports — Professional Review Required
ALL REPORTS GENERATED BY THIS SERVICE ARE DRAFTS FOR PROFESSIONAL REVIEW ONLY. The draft analysis reports generated by the Service are intended as a starting point for licensed professionals to review, verify, and refine. They do not constitute legal advice, legal opinion, or legal representation. Use of the Service does not create a solicitor-client relationship between you, your clients, and WakaAi Solutions Inc.
The reports are generated by an artificial intelligence system. While the system is designed using legal frameworks developed by experienced Canadian immigration practitioners, the output is machine-generated and may contain errors, omissions, or inaccurate legal analysis. Licensed professionals must independently verify all content before relying upon it or sharing it with clients.
Draft reports must not be provided to clients or relied upon without independent professional review. As a licensed professional, you are responsible for verifying the accuracy of all AI-generated content and exercising your independent professional judgment in advising your clients.
3. Eligibility
You must be at least 18 years of age to use the Service.
4. Payment and Pricing
The Service charges a one-time fee per analysis report. All fees are in Canadian Dollars (CAD). Payment is processed securely through Stripe. WakaAi Solutions Inc. does not store your credit card information.
5. Refund Policy
All sales are final once an analysis report has been generated and delivered. If the Service fails to generate a report due to a technical error, you are entitled to a replacement analysis or a full refund at our discretion. Contact support@visarefusalanalyzer.com for assistance.
6. Client Document Upload and Data Handling
By uploading client documents, you represent and warrant that you have appropriate authorization from your client to upload their documents to this service for AI-powered analysis. Documents are transmitted to Anthropic's API (a US-based AI provider) for processing and are deleted after analysis is complete. You are responsible for assessing whether this third-party processing is consistent with your professional confidentiality obligations and for obtaining any necessary client consent. 7. Accuracy and Limitations
We do not guarantee that analysis reports are error-free, complete, or suitable for any particular purpose. The AI system may misinterpret documents. Immigration law changes frequently. The analysis reflects legal standards as understood by the AI system and may not reflect the most recent developments.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAKAAI SOLUTIONS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING DAMAGES FROM RELIANCE ON ANALYSIS REPORTS OR MISSED LEGAL DEADLINES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ANALYSIS REPORT.
9. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
